FIRM OBTAINS DISMISSAL OF RICO CLASS ACTION

Schenk & Bruetsch obtained summary judgment in favor of our clients in a federal class action lawsuit making claims against multiple parties under the Racketeer Influenced and Corrupt Organizations Act (RICO). RICO claims are highly complex, and the possible exposure exceeded $30 million. Our clients came to Schenk & Bruetsch in the middle of the case after initially hiring a large business firm to defend them. Despite joining the action in mid-stream, we were able to reshape the defense, focus the legal theory, and obtain discovery that supported our clients’ position that they did not harm the plaintiffs. Ultimately, the Court agreed and entered judgment in our clients’ favor before trial. Thomas Bruetsch led the successful defense.
